In response to the growing demand for resources provided by counties to Special Purpose Districts across Texas, like law enforcement and emergency services, State Representative Keith Bell filed today crucial legislation aimed at safeguarding the interests of our counties and communities while ensuring responsible growth.
Texas, with its diverse and expanding population, relies on Special Purpose Districts to meet various community needs, from Municipal Utility Districts (MUDs) to Health and Hospital Districts. However, as we have witnessed in cases like Colony Ridge in Liberty County, there is a need to strike a balance between these districts’ formation and the effective management of that population growth within the county.
Counties across Texas face numerous challenges by these districts being es-tablished without county approval or oversight, often leading to subs tandard infrastructure and scarcity of law enforcement and emergency services to these new communities. As of today, only a handful of special purpose districts that seek establishment in a county go before the County Commissioner’s Court for approval and planning. This, combined with no zoning laws, creates a “wild west” environment in county growth.
Under Representative Bell’s proposed legislation, all Special Purpose Districts, except those already with established county approval processes in statute, will be required to seek initial approval from the County Commi s sioner’s Court before proc eeding with formal state agency application processes. This approach ensures a thorough assessment of potential impacts on county resources, infrastructure, and economic development, thus safeguarding the interests of the local community.

The bill establishes a transparent and accountable oversight process that empowers the locally elected members of County Commissioner’s Courts to evaluate and approve the creation of Special Purpose Districts within their jurisdictions. This process will involve public hearings to foster community engagement, ensuring that the establishment of such districts complements available resources and infrastructure capacity. District formation that goes through the state legislative process as a local law will not be affected by this bill.
