District Attorney Erleigh Norville Wiley announced Tuesday September 20th, a Kaufman County jury has sentenced BRIAN ALLAN KOHLER, 48, to 80 years in the Texas penitentiary. After a three-day trial before Honorable Judge Casey Blair in the 86th District Court of Kaufman County, a jury found Kohler guilty of Sexual Assault of Child Enhanced and sentenced Kohler to 80 years.
The jury heard evidence that Kohler had sexually assaulted his daughter from age 9 to 17, on a weekly and sometimes daily basis. The victim, Ellis, told the jury that when she was 11 years old, Kohler bought her a pair of fish-net stockings as a Christmas gift. After confronting Kohler about the constant abuse on a recorded call, Kohler is quoted as telling his daughter, “I just wanted to hold you and be close to you . . . I don’t know, you were my escape.” The victim, Ellis, further told the jury that Kohler’s abuse continues to haunt her life, even years after she moved out of Kohler’s home.
The jury found Kohler guilty of the first-degree felony of Sexual Assault of a Child Enhanced after deliberating for less than half an hour. At punishment, jury again took only minutes to assess Kohler’s punishment at 80 years in the Texas Department of Criminal Justice, Institutional Division.
The prosecution was led by Assistant Criminal District Attorneys Ashley Holman and Taylor McConnell, Crimes Against Children Investigator Brandi Dial and paralegal Amanda Morris. Additionally, the District Attorney’s Office would like to thank the victim, Ellis, who showed incredible bravery while facing her abusive father at trial. District Attorney Wiley told media, “Kaufman County juries have made clear that this County will not tolerate the abuse of our children.”
