In litigation recently concluded, the City of Mesquite successfully defended the Coin-Operated Amusement Devices Ordinance passed in October 2020 and has started enforcement. The ordinance limits locations where devices are allowed and requires a Conditional Use Permit (CUP) for businesses that desire to have more than two coin-operated amusement devices. A CUP is required to help prevent the use of such devices having adverse effects on nearby properties.
Requirements for coin-operated amusement devices include the following.
• All coin-operated amusement devices are prohibited within 300 feet of a church, school, or hospital.
• A maximum of two coin-operated amusement devices are allowed by right as an accessory use to an approved principal use. More than two devices require approval of a CUP.
• All game rooms and coin-operated amusement devices must be kept open and accessible during business hours.
• All coin-operated amusement devices must be licensed through the City of Mesquite Building Inspection Division.
